Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") are a binding agreement between you and Qwikab ("Qwikab", "we", "us", or "our") governing your access to and use of the Qwikab website, mobile applications, driver portal, and related services (collectively, the "Service").

By creating an account, booking a ride, registering as a driver partner, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. What Qwikab provides

Qwikab operates a technology platform that connects riders ("Passengers") with independent professional drivers and fleet partners ("Drivers") for premium ground transportation in Ghana and other markets we serve.

Our services include, where available: airport pickups with flight tracking, on-demand quick rides, scheduled tour rides, and hourly chauffeur hire. Service availability may vary by city and may be introduced gradually.

Qwikab is a booking and facilitation platform. We do not own vehicles, employ Drivers, or operate as a common carrier. Transportation is provided by independent Drivers who are responsible for their own licensing, insurance, vehicle condition, and compliance with applicable road and transport laws.

3. Eligibility and accounts

You must be at least 18 years old and legally able to enter a binding contract to use the Service as a Passenger. Drivers must meet separate onboarding, licensing, and vehicle requirements communicated during driver registration.

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at support@qwikab.com if you suspect unauthorized access.

You agree to provide accurate, current, and complete registration information (including name, email, phone number, and payment details) and to update it when it changes. We may suspend or terminate accounts that contain false information or are used in violation of these Terms.

4. Bookings and trip requests

When you request a ride, you authorize us to match you with an available Driver and to share trip details necessary to complete the service, including pickup and drop-off locations, contact information, and special instructions.

A booking is not guaranteed until confirmed in the app. We may cancel or reassign a trip for operational, safety, or availability reasons. If we cancel a confirmed prepaid trip, we will refund or credit you as described in our cancellation policy.

You agree to be present at the pickup location at the scheduled time, to verify the Driver and vehicle details shown in the app before entering the vehicle, and to provide accurate pickup and destination information.

For airport pickups, you may provide flight information so we can monitor arrival times. Flight data is provided by third-party sources and may not always be accurate; you remain responsible for communicating delays or changes.

5. Fares, fees, and payments

Fares are displayed before you confirm a booking and are calculated based on service type, vehicle category, distance, duration, demand, tolls, airport fees, and any promotions shown at checkout. Currency is typically Ghana Cedis (GHS) unless otherwise stated.

By confirming a booking, you authorize Qwikab and our payment processor (including Paystack) to charge your selected payment method for the quoted fare, applicable taxes, tolls, waiting-time charges, cleaning fees, or other adjustments permitted under these Terms and shown in the app.

Payments may also be made through an in-app wallet where available. Wallet balances are non-transferable except as required by law and may be subject to additional wallet terms shown in the app.

Receipts are provided electronically after completed trips. If you believe a charge is incorrect, contact support@qwikab.com within 14 days of the trip with your booking reference.

6. Cancellations, no-shows, and refunds

Cancellation fees and refund eligibility depend on the service type, how far in advance you cancel, and whether a Driver has already been dispatched or arrived. The applicable policy is shown before you confirm a booking and at the time of cancellation.

If you do not appear at the pickup point within the waiting period shown in the app, the trip may be marked as a no-show and you may be charged a no-show or cancellation fee.

Approved refunds are processed to the original payment method or wallet within a reasonable period. Processing times may depend on your bank or payment provider.

We may issue account credits in place of refunds where permitted. Promotional credits have no cash value and may expire.

7. Driver partners

Drivers who use the Qwikab platform agree to maintain valid driving licences, vehicle registration, insurance, and any permits required by Ghana law and local authorities. Drivers are independent contractors or business partners, not employees of Qwikab.

Drivers must accept trips only when they can perform them safely and lawfully, follow in-app navigation and trip status updates, treat Passengers respectfully, and maintain vehicles in clean and roadworthy condition.

Qwikab may deactivate Driver accounts for safety concerns, poor ratings, policy violations, fraudulent activity, or failure to meet platform standards. Earnings, payouts, and deductions are governed by the driver agreement and in-app earnings summaries.

8. Acceptable use and prohibited conduct

You agree to use the Service lawfully and respectfully. You may not harass, threaten, discriminate against, or endanger Drivers, Passengers, Qwikab staff, or others.

Prohibited activities include: fraud or payment abuse; creating fake bookings; tampering with ratings or reviews; using the Service for illegal goods or activities; carrying weapons or hazardous materials without lawful authority; smoking or consuming illegal substances in vehicles where prohibited; attempting to circumvent fares or fees; scraping or reverse engineering the platform; or misusing another person's account.

We may investigate violations, cancel trips, withhold payouts, suspend or terminate accounts, and cooperate with law enforcement where required.

9. Ratings, feedback, and communications

After trips, Passengers and Drivers may rate and review each other. Reviews must be honest and may not contain abusive, defamatory, or discriminatory content. We may remove reviews that violate our policies.

By using the Service, you consent to receive transactional communications by email, SMS, push notification, or in-app message, including booking confirmations, driver arrival alerts, receipts, and safety notices. Marketing messages, where sent, will include an opt-out where required by law.

10. Safety

Your safety matters. Before entering a vehicle, confirm that the Driver name, photo, vehicle make, model, and licence plate match the details shown in the app.

If you are in immediate danger, contact local emergency services first (for example, Ghana Police at 191 or Ghana National Ambulance at 193).

For non-emergency safety concerns, contact us at safety@qwikab.com. We may record and share trip-related information, including GPS data and in-app communications, with law enforcement or regulators when necessary to investigate incidents or protect users.

Qwikab does not guarantee that every trip will be free from risk. Drivers are responsible for safe operation of their vehicles.

11. Intellectual property

The Service, including the Qwikab name, logos, software, design, and content, is owned by or licensed to Qwikab and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable licence to use the Service for personal or authorised business use.

You may not copy, modify, distribute, sell, lease, or reverse engineer any part of the Service except where expressly permitted by law.

12. Third-party services

The Service integrates with third parties such as payment processors (including Paystack), mapping providers (including HERE), sign-in providers (including Google), and hosting providers. Your use of those services may be subject to their separate terms and privacy policies.

Qwikab is not responsible for third-party outages, payment failures caused by your bank or card issuer, or inaccuracies in third-party map, traffic, or flight data.

13. Disclaimers

The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not warrant uninterrupted access, error-free operation, or that every trip will meet your expectations.

Qwikab does not control Driver conduct, vehicle condition, or route choices except through platform policies and tools. We are not a party to the transportation contract between Passenger and Driver.

14. Limitation of liability

To the maximum extent permitted by applicable law, Qwikab and its directors, officers, employees, affiliates, and agents shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or personal injury arising from your use of the Service or any trip arranged through the platform.

Our total liability to you for any claim arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the fees you paid to Qwikab for the trip giving rise to the claim, or (b) one hundred Ghana Cedis (GHS 100), except where liability cannot be limited under Ghana law.

Nothing in these Terms excludes liability for death or personal injury caused by negligence where such exclusion is unlawful, or for fraud or fraudulent misrepresentation.

15. Indemnification

You agree to indemnify and hold harmless Qwikab and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, your violation of any law or third-party rights, or any trip conduct for which you are responsible.

16. Suspension and termination

You may stop using the Service at any time and may request account deletion through support or in-app settings where available.

We may suspend or terminate your access immediately if you breach these Terms, pose a safety risk, engage in fraud, or if required by law. Provisions that by their nature should survive termination — including payment obligations, disclaimers, limitation of liability, indemnity, and dispute resolution — will survive.

17. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms on this page and update the effective date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

If you do not agree to updated Terms, you must stop using the Service.

18. Governing law and disputes

These Terms are governed by the laws of the Republic of Ghana, without regard to conflict-of-law principles.

Before filing a formal claim, you agree to contact us at support@qwikab.com and attempt to resolve the dispute informally within 30 days.

Subject to mandatory consumer protections, disputes that cannot be resolved informally shall be submitted to the competent courts of Accra, Ghana, unless applicable law requires a different forum.
